The Certificate in Contract Law 2 is a Level 8 programme designed to develop a deeper understanding of the principles and theories that underpin contract law. This programme examines advanced areas of contract law and explores how contractual rights and obligations are created, enforced and discharged.
You will study the role of equitable principles in contract law, including doctrines such as duress, undue influence and unconscionable bargains, and examine how Irish courts apply these principles in contractual disputes. The programme also explores the various ways in which contractual obligations may be discharged, including performance, agreement, breach of contract and frustration.
Learners will develop an understanding of the remedies available when contractual obligations are breached, including damages, specific performance, injunctions, rescission and rectification. The programme examines the legal principles governing compensation and the factors considered by courts when assessing contractual remedies.
A further focus is placed on the rights of third parties in contract law. You will explore the doctrine of privity, its historical development and the exceptions that permit third parties to acquire rights or benefits under contractual arrangements.
Through the analysis of legal cases, legislation and practical scenarios, learners will strengthen their legal reasoning, research and problem-solving skills while developing the ability to apply contract law principles in a range of contexts
